Why Unum denies or terminates long-term disability claims

Unum policies differ. The denial letter and full policy control your claim. These issues appear in reported disputes involving Unum Life Insurance Company of America and show where an appeal may need focused evidence.

The switch from your occupation to any gainful occupation

Some policies change their disability definition after an initial benefit period. In Zayn, the plan applied an any-gainful-occupation test after 24 months. A job title on a vocational list does not answer whether you can perform work reliably with your actual symptoms, education and restrictions.

File reviews versus treating and examining clinicians

Unum may rely on clinicians who review records without examining the claimant. In Zayn, the court found the claimant’s longitudinal treating evidence more reliable than certain file reviews, one of which used facts from another claim file. An appeal should address every disputed medical conclusion with the underlying records and functional limits.

Pain, fatigue and cognitive symptoms that affect sustained work

Symptoms may fluctuate or be hard to capture in a single exam. In Johndrow, the court evaluated years of headache and pain evidence and found the claimant disabled under the policy. Consistent treatment notes, testing and specific accounts of work capacity can matter.

Surveillance, social posts and limited daily activities

A short activity, a hobby or an accommodated trip may be cited as proof of work capacity. Zayn held that the claimant’s limited activities were consistent with disability on that record. Explain how long an activity lasts, what help it takes and what happens afterward.

Mental-health or self-reported-symptom limits

Some policies limit benefits for certain conditions. In Johndrow, Unum had invoked a mental-illness limitation while the court examined the evidence of physical symptoms and functional impairment. The exact policy wording and medical basis for each condition matter.

A new theory late in the process

In Anderson-Posey, the court remanded after Unum advanced a medication-related theory without adequate findings and without giving the claimant a chance to respond before suit. The appeal should track every stated reason and insist on a fair chance to answer new evidence.

Most employer-sponsored long-term disability plans fall under ERISA. You ordinarily must use the plan’s administrative appeal before filing a benefits suit. Courts often focus on the record that was before the insurer, so waiting until litigation to collect key evidence can be costly.

Reversed and remanded

Anderson-Posey v. Unum Life Insurance Co. of America

237 F. Supp. 3d 1144 (N.D. Okla. 2017) · U.S. District Court for the Northern District of Oklahoma

The court reversed Unum’s termination of LTD benefits and sent the claim back for further review. It found Unum had not adequately investigated or explained a late medication-related basis for its decision, and the claimant had not had an opportunity to respond to that theory before suit. The court did not order benefits outright.

A remand can require a fairer claim review, without itself awarding benefits.

Benefits awarded after earlier remand

Johndrow v. Unum Life Insurance Co. of America

833 F. Supp. 3d 837 (E.D. Tenn. 2026) · U.S. District Court for the Eastern District of Tennessee

After a 2023 remand for further review and an independent medical examination, Unum again denied the claim. On the renewed court review, the judge found the claimant disabled under the policy as of March 9, 2021, reversed Unum’s denial and awarded continuing LTD benefits. This is one case with two stages, not two separate claimant wins.

The full medical record and sustained ability to work can be decisive even after a remand.

Zayn v. Unum Life Insurance Co. of America

2026 U.S. Dist. LEXIS 208052 (D. Or. Sept. 15, 2026) · U.S. District Court for the District of Oregon

On the record before it, the court credited treating-provider evidence of progressive Parkinson’s-related limits and found that brief activities and hobbies did not establish sustained work capacity. It granted the claimant judgment and ordered LTD benefits reinstated effective November 27, 2024; the amount of back benefits and fees remained to be determined.

Unum denied my long-term disability claim. What should I do first?

Keep the denial letter and record when you received it. Check the appeal instructions, request the full claim file and policy, and speak with counsel before submitting a short or incomplete appeal. The governing plan and letter control your deadlines.

How long do I have to appeal a Unum LTD denial?

For most ERISA-governed disability plans, federal rules require at least 180 days after receipt of the denial to appeal. Individual policies and exempt plans can differ. Do not rely on a generic estimate; confirm the deadline shown in your letter and policy.

How long does Unum have to decide an ERISA disability appeal?

The usual ERISA disability appeal period is 45 days, with a possible 45-day extension if the plan gives timely notice of special circumstances. Tolling and other rules can affect the actual date. Keep copies of all notices.

Unum says I can do any gainful occupation. Can I challenge that?

Yes, if the evidence supports it. The policy definition and your real functional limits matter. In Zayn, the court found that limited hobbies and activities did not show the claimant could sustain gainful work under that plan.

Can Unum use a paper review instead of my treating doctor?

Unum may use file reviewers, and there is no automatic rule that a treating opinion wins. A court can still find a treating opinion more persuasive when it is better grounded in the complete record, as in Zayn.

Can I sue Unum for long-term disability benefits?

For ERISA employer plans, you usually must complete the required administrative appeal first. If Unum upholds the denial, a claimant may seek benefits under ERISA Section 502(a)(1)(B). Different rules apply to individual and some non-ERISA policies.

What if Unum reduced my benefit because I received Social Security Disability?

Some policies offset LTD benefits by Social Security Disability payments. The wording and payment history determine the amount, and a retroactive award can trigger an overpayment claim. Bring the policy, Unum calculation and SSA notice to the review.
